1. Your agreement with us
These Terms of Service govern access to ETF Tracker, including etftracker.io, its account services, research, charts, visualizations, watchlists, email updates, issuer tools, portfolio connections, shared pages, and related features (collectively, the “Service”). The Service is operated by WOLF Financial Puerto Rico, LLC (“Company,” “ETF Tracker,” “we,” “us,” or “our”). “You” includes an individual user and any organization on whose behalf that individual is authorized to act.
By affirmatively accepting these Terms when signing in, creating an account, or continuing after an update, you enter a binding agreement with the Company. If you accept for an organization, you represent that you have authority to bind it. You must not create an account, connect financial accounts, submit issuer material, or use account features if you do not agree. Public material remains subject to applicable intellectual property, access, and other legal restrictions.
The Privacy Policy explains the processing of personal information and is linked throughout the Service. Specific product terms, provider agreements, and notices presented when a feature is used may also apply. A specific feature agreement controls a conflict concerning that feature; mandatory law always controls. General explanations, summaries, tooltips, and marketing statements do not replace this agreement or an express written commitment.
2. Eligibility, location, and authority
You must be at least 18, have legal capacity to enter this agreement, and be legally permitted to use the Service where you are located. The Service is intended principally for adults researching investments in the United States and Puerto Rico. Availability on the internet does not mean that the Service, a security, a brokerage integration, or a promotion is appropriate or authorized in every jurisdiction.
You are responsible for local requirements, permissions, taxes, devices, connectivity, and any third-party charges. You may not use the Service in violation of applicable sanctions, export controls, or restrictions, or on behalf of a prohibited person. We may restrict locations, institutions, account types, users, or features at our discretion, subject to applicable law.
3. Accounts and account security
An account may be created the first time you use an email sign-in code, email link, or supported identity provider. Provide accurate information, keep it current, and use only an email address and identity you control or are authorized to use. You are responsible for maintaining the security of your email, identity-provider account, devices, sessions, and sign-in links. Do not share codes or impersonate another person.
Notify us promptly at charles@wolf.financial if you suspect unauthorized access. We may require verification, reject registration, limit sessions, revoke access, or suspend an account to investigate abuse, comply with law, or protect the Service. We do not promise that every unauthorized action can be prevented, reversed, or recovered. Your responsibility for account activity is subject to applicable law and does not make you responsible for unauthorized activity to the extent the law provides otherwise.
An account is personal unless we expressly approve organizational access. You may not sell, transfer, sublicense, or create accounts to evade a restriction. You remain responsible for the authority of people you permit to act through your account.
4. Information only; no investment advice or fiduciary relationship
The Service provides general financial information, education, research tools, and automated calculations. It does not provide personalized investment, financial, legal, accounting, or tax advice. Unless the Company separately agrees in an express written agreement for a properly authorized regulated service, the Service does not act as your investment adviser, broker-dealer, financial planner, custodian, investment manager, fiduciary, or agent for investment decisions.
A ranking, score, category, comparison, chart, model, watchlist, portfolio summary, suggested theme, statement about a fund, or displayed Buy button is not a recommendation, solicitation, offer to buy or sell, endorsement, suitability assessment, or instruction to trade. Connecting a portfolio or receiving analysis based on its holdings does not create an advisory relationship or establish that we have considered your objectives, risk tolerance, time horizon, tax circumstances, liquidity needs, debts, or complete financial position.
You alone decide whether and how to invest. Consult appropriately qualified professionals, independently evaluate each security, and review current prospectuses, statements of additional information, issuer filings, and broker disclosures before acting. Do not treat the Service as the sole basis for any financial decision.
5. Investment risks and responsibility for decisions
All investments involve risk, including loss of the entire amount invested. Prices, distributions, yields, expenses, liquidity, tracking, and tax treatment can change without notice. Past results, a current yield, a backtest, a hypothetical return, or an illustrative example do not predict or guarantee future performance or income. Diversification does not eliminate loss, and a low fee does not establish that an investment is suitable.
Leveraged, inverse, derivative-based, options-based, single-security, thematic, commodity, and crypto-related products may involve leverage, counterparty exposure, concentration, volatility, liquidity constraints, complex taxes, and losses magnified by daily resets or compounding. Results over multiple days can differ substantially from a stated daily multiple or inverse objective. A distribution may include return of capital and may reduce net asset value; distribution rate is not the same as total return or sustainable yield.
You bear responsibility for your investment choices, broker instructions, tax reporting, account permissions, and compliance obligations. We do not guarantee execution, returns, capital preservation, availability of funds, or eligibility for any regulatory, deposit, or brokerage protection. Any protection that applies to your broker account is determined by the broker and applicable law, not by the Service.
6. Data accuracy, delays, corrections, and third-party sources
Information may come from market-data vendors, exchanges, issuers, regulatory filings, brokerage integrations, public sources, users, and our own calculations. It may be incomplete, stale, delayed, estimated, misclassified, duplicated, rounded, unavailable, or incorrect. A displayed observation date is not a promise of real-time delivery. Different sources, time zones, currencies, market sessions, corporate-action methods, and calculation conventions can produce conflicting results.
Quotes are not executable prices. Holdings may reflect a historical reporting date rather than current positions. A net asset value may differ from a market price; fund premiums and discounts fluctuate. Expense, distribution, tax, benchmark, launch-date, assets-under-management, and security-classification data can change or require later correction. Documents and issuer descriptions may remain available after they become outdated.
We may correct, replace, recalculate, remove, or stop displaying information without notice and have no general duty to monitor every item or provide an update, except where law requires otherwise. No provider or Company representative guarantees that the Service is complete or error-free. Verify information directly with an authoritative source and your broker before trading, transferring money, reporting taxes, or otherwise relying on it. Your broker’s official records control your brokerage account.
7. Charts, portfolio analysis, models, and sample data
Calculations simplify reality and depend on available inputs and assumptions. Returns can differ depending on price adjustment, dividend reinvestment, distributions, cash flows, start dates, currency conversion, fees, taxes, and missing observations. A fee or income estimate may annualize an observation and may not include transaction costs, spreads, borrowing, taxes, or changes in distributions.
A chart replaying today’s portfolio holdings over a historical period is hypothetical. It is not your actual account performance, a record of your historical trades, or proof that the same holdings or allocations existed in that period. Benchmark comparisons may omit timing, rebalancing, deposits, withdrawals, cash, or holdings we cannot identify. Look-through exposure, overlapping companies, sectors, diversification, concentration, and risk measures are estimates that may exclude unavailable holdings or use mismatched reporting dates.
Sample portfolios, demonstration funds, example transactions, simulated connections, and illustrative graphics are not actual user accounts, executable orders, or verified market history. Labels identify sample contexts. Automated written summaries and any future machine-assisted features may be inaccurate or incomplete; review the underlying information. We do not undertake to validate a model for your particular use.
8. Connecting a brokerage and authorizing data access
Portfolio connections are optional and use SnapTrade or another provider identified in the connection flow. By separately authorizing a connection, you represent that you own or are authorized to access each linked account and to permit the collection and processing described here and in the Privacy Policy. Do not connect employer, client, family, joint, trust, or other third-party accounts unless you have every required authorization.
Your authorization permits the integration provider and the Company to retrieve and refresh the account information made available within the permissions you grant, including institution and account identifiers, masked account details, holdings, quantities, balances, values, cash, currency, cost information, connection status, and other supported financial information used by the feature. Collection may continue while the connection remains active. Your provider or broker may control the scope, frequency, and duration of access.
Broker authentication occurs in the integration or broker flow. Do not send us brokerage passwords, multifactor codes, recovery phrases, or full account numbers by email or through portfolio notes. We use provider-issued connection credentials to retrieve authorized data; our connection does not transfer custody of your assets to the Company.
You must also agree to the integration provider’s applicable end-user terms and acknowledge its privacy policy. Those independent agreements govern that provider’s processing and responsibilities. We may refuse or terminate a connection for technical, contractual, security, or legal reasons. Your authorization is not a promise that every institution, position, or account type will be supported.
Read the SnapTrade End User Terms and SnapTrade Privacy Policy before connecting.
9. Portfolio data license and our discretion within the platform
As between you and the Company, you retain rights you have in the information you provide. You grant the Company a nonexclusive, worldwide, royalty-free license to access, collect, host, store, cache, copy, normalize, combine, organize, analyze, adapt, calculate from, and otherwise process your submitted and connected data to operate, secure, support, maintain, develop, improve, and commercialize the Service, subject to the Privacy Policy, the permissions you grant, provider restrictions, and applicable law.
Within those limits, we may decide at our discretion how data is organized, weighted, analyzed, categorized, compared, and used in platform features. Permitted purposes include portfolio views, fund look-through analysis, comparisons, estimates, derived statistics, personalization, product research, testing, quality measurement, fraud detection, support, and development of new or paid platform features. Authorized personnel and service providers may access data as reasonably necessary for those purposes; individual access must remain consistent with the Privacy Policy.
We may create and use aggregated or deidentified statistics and insights for research, reporting, benchmarking, product development, and commercial analytics, including sharing or licensing those statistics where they cannot reasonably identify you and where the law and provider agreements permit. We will maintain information represented as deidentified in deidentified form and will not attempt to reidentify it except as permitted by law to validate deidentification.
This license does not transfer ownership of your brokerage account, authorize a trade, make your identifiable holdings public, or give the Company unrestricted rights over personal information. It does not waive privacy rights, allow a prohibited sale or disclosure, or substitute for a separate consent required for sensitive information or a materially different purpose. Public display of your identifiable portfolio depends on the sharing controls you use. Personal information is always governed by the Privacy Policy and applicable law.
The operational license lasts while reasonably necessary for the stated purposes and any lawful retention described in the Privacy Policy. Rights in legitimately deidentified or aggregated information and Company-created methods and nonpersonal outputs may survive disconnection or account closure. A deletion request or withdrawal is handled subject to applicable rights, lawful exceptions, and provider obligations; this section does not make personal-data permission irrevocable.
Read the connected-data notice and platform analytics policy.
10. Refreshes, revocation, and disconnection
Connections can break, require reauthentication, return partial information, or stop updating without warning. You are responsible for checking connection status and comparing the display with your institution’s records. We may cache data or store periodic snapshots, so a displayed portfolio may not reflect a recent transaction or change.
You can disconnect a brokerage in Portfolio or revoke access with the provider or broker where supported. Disconnecting stops further retrieval through that authorization once processed; it does not close your broker account or cancel an order. In the current implementation, removing your last brokerage also removes stored portfolio snapshots and share links associated with that integration. Your thesis, account, watchlists, legal acceptance receipts, support records, backups, and records retained for lawful purposes may remain as described in the Privacy Policy. To request broader deletion, contact us.
Data or images already copied, downloaded, or redistributed by you or someone else may remain outside our control. Independent providers retain information under their own policies and legal obligations. Disconnecting one account does not automatically revoke other authorizations.
11. Trading features and broker handoffs
A Buy button may lead to a brokerage website, a connection flow, a demonstration, or, only if separately enabled and authorized, an order workflow. A data connection is read-only unless an additional trading permission is expressly granted. Neither accepting these Terms nor providing data consent authorizes discretionary trading, money movement, account management, or automatic purchases.
If trading is available, you must select an eligible account, review the security, direction, quantity or dollar amount, order type, estimated price, fees, and other information, and affirmatively submit the order. A preview is an estimate and is not a completed trade. Your broker and integration provider determine acceptance, execution, cancellation, fills, settlement, buying power, eligibility, and charges. Market movement, outages, delays, halts, partial fills, duplicate submissions, and rejected or expired instructions can affect results.
You remain responsible for confirming order status directly with the broker before repeating an instruction. We do not guarantee a price, execution time, cancellation, tax outcome, or reversal. Your broker agreement and mandatory securities protections continue to apply. We may disable trading or a broker integration at any time where lawful. Third-party broker links and provider names do not imply a partnership, recommendation, or guarantee.
13. Issuer accounts, submissions, and conflicts
An issuer representative must truthfully identify their affiliation and have authority to act for the issuer and to submit documents, logos, descriptions, videos, and other materials. A claimed profile or verified affiliation does not establish that the Company approves the issuer, verifies every statement, or recommends a product. You are responsible for required regulatory approvals, filings, copyright permissions, disclosures, and recordkeeping applicable to your submissions.
You grant us a nonexclusive, worldwide, royalty-free license to host, transcode, reproduce, format, display, and distribute issuer material through the Service and its promotion, subject to any separate written agreement. We may review, reject, edit formatting, label, suspend, or remove a submission. Submission does not guarantee publication, placement, traffic, or results. Do not submit material that is misleading, violates securities or advertising requirements, infringes rights, or conceals a material relationship.
The Company, affiliates, contributors, or personnel may hold or trade securities discussed by the Service. Commercial relationships, sponsored material, advertising, referral arrangements, or compensation may create conflicts. Material paid relationships will be disclosed where required. Payment, a listing, or an issuer relationship does not make a product suitable for you or convert general information into individual advice.
14. Watchlists, newsletters, alerts, and communications
Saving a fund does not guarantee that you will receive alerts, and alerts are not a real-time trading or risk-monitoring service. Email delivery can fail, arrive late, be filtered, or contain an error. We may change frequency, combine updates, suspend delivery, or retire an email feature. Do not rely on an alert to detect a loss, deadline, distribution, corporate action, or trading opportunity.
Optional newsletters and fund emails use separate preferences and consent where required. Accepting these Terms does not automatically subscribe you to marketing. You can change available settings or use an unsubscribe link. We may still send essential account, security, legal, or transactional messages when appropriate and lawful. Electronic communications satisfy written-notice requirements to the extent permitted by law; retain a copy for your records.
15. Free features, paid plans, and third-party fees
A feature described as free has no Company subscription charge under the displayed offer; internet, brokerage, data, tax, transaction, and provider charges may still apply. We may introduce paid features or change prospective prices, with the disclosures and consent required by law. We will not treat acceptance of these Terms as approval of an undisclosed charge.
If a paid plan becomes available, the price, billing interval, renewal terms, cancellation method, and refund policy presented at checkout or in a separate agreement govern that purchase. You must affirmatively authorize any recurring billing where required. No payment, automatic renewal, or refund promise is created solely by these general Terms. Mandatory cancellation and refund rights remain available.
16. Limited permission to use the Service
Subject to these Terms and applicable data licenses, we grant you a limited, revocable, nonexclusive, nontransferable permission to access the Service for your own lawful informational use. An organizational account may use expressly enabled tools for its authorized internal purposes. This permission does not grant redistribution, resale, bulk extraction, a data feed, an API entitlement, or a right to build a competing product from Service content.
Third-party data may be subject to exchange, vendor, issuer, or regulator restrictions. Attribution and notices must remain intact. Availability of a page, download, graphic, or technical endpoint does not grant rights beyond the feature’s intended purpose. Obtain our written permission and any required provider licenses before a commercial reuse outside the sharing tools.
17. Prohibited conduct
You must not, and must not assist another person to:
- Break applicable law, submit false information, impersonate a person or institution, misrepresent authority, or connect an account without permission.
- Access another user’s data, misuse credentials or share tokens, evade authentication or rate limits, interfere with security, introduce malware, or exploit a vulnerability to obtain information or disrupt availability.
- Scrape, harvest, crawl at abusive volume, bulk-download, redistribute, resell, republish, or commercially exploit content or provider data except through expressly authorized functionality or written permission.
- Reverse engineer nonpublic systems, bypass access controls, remove ownership or source notices, or use the Service to construct an unauthorized competing database or feed, except where mandatory law permits an activity despite this restriction.
- Use personal information for profiling, harassment, discrimination, identity theft, unsolicited communications, or any purpose inconsistent with the subject’s rights or your authorization.
- Upload unlawful, defamatory, infringing, deceptive, threatening, or malicious material; use the Service for market manipulation, fraud, sanctions evasion, or unlawful investment promotions.
- Overload infrastructure, use automated accounts to evade limits, probe systems without authorization, or use Service content for model training or automated commercial extraction without an express license.
18. Intellectual property and feedback
The Company and its licensors retain rights in the Service’s software, design, visualizations, methods, calculations, compilations, branding, original editorial material, and other protected content. Third-party names, marks, data, and documents belong to their owners. No ownership is transferred by creating an account or submitting portfolio data. Rights in personal information remain subject to applicable law and the Privacy Policy.
You may provide suggestions or feedback voluntarily. You grant us a perpetual, worldwide, royalty-free right to use and incorporate nonconfidential feedback without payment or attribution, subject to applicable law. Do not include personal information, confidential business material, or third-party secrets in feedback. This feedback license does not enlarge the personal-data license in the portfolio section.
For a good-faith intellectual-property complaint, email charles@wolf.financial with your contact information, the protected work or right, the exact material and URL, the basis for your authority, and a statement that your information is accurate. We may request additional details or remove material while a complaint is reviewed. Do not submit a knowingly false claim.
19. Independent services and links
The Service depends on independent hosts, identity providers, data vendors, email providers, issuers, brokers, and connection providers. Their availability, processing, terms, privacy practices, and charges are their responsibility under their own agreements and applicable law. We do not control their systems and cannot promise uninterrupted access, continuing compatibility, or performance of their obligations.
A link or embedded third-party item is provided for convenience and does not establish endorsement, verification, or a guarantee. Review third-party terms before leaving the Service or granting permissions. Nothing in these Terms excludes a Company responsibility that applicable law imposes for our own selection, conduct, instructions, or handling of your information.
20. Changes, maintenance, and availability
We may modify, limit, suspend, discontinue, or replace features, supported institutions, datasets, or the Service, temporarily or permanently, where lawful. Maintenance, internet failures, cyberattacks, provider outages, licensing changes, regulatory requirements, market events, and circumstances outside our reasonable control can interrupt access. We do not promise a service level, response time, archive, recovery point, or perpetual availability unless we expressly agree in writing.
You should retain records and copies you need independently of the Service. We may impose reasonable usage and storage limits. Where advance notice, access to records, refunds, or other measures are required by law or a paid agreement, those obligations remain in effect.
21. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, DATA, CALCULATIONS, LINKS, AND FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. THE COMPANY AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, SECURITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
WE DO NOT WARRANT THAT A SECURITY OR STRATEGY WILL PRODUCE A RETURN; THAT ANALYSIS WILL MATCH YOUR BROKER OR TAX RECORDS; THAT ERRORS WILL ALWAYS BE FOUND OR CORRECTED; THAT A CONNECTION, ALERT, OR ORDER WILL ARRIVE ON TIME; OR THAT THE SERVICE WILL MEET YOUR PARTICULAR REQUIREMENTS. NO GENERAL STATEMENT OR INFORMAL COMMUNICATION CREATES A WARRANTY NOT EXPRESSLY SET OUT IN A BINDING WRITTEN AGREEMENT.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusion applies only to the extent permitted. Express commitments, mandatory consumer guarantees, and rights that cannot lawfully be disclaimed are preserved.
22. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, AND THEIR RESPECTIVE OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS (THE “COMPANY PARTIES”), WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, TRADING LOSSES, LOST OPPORTUNITIES, LOST REVENUE, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR LOSS OR CORRUPTION OF DATA ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID THE COMPANY FOR THE SERVICE IN THE 12 MONTHS IMMEDIATELY BEFORE THE EVENT FIRST GIVING RISE TO THE CLAIM. THIRD-PARTY BROKER FEES, INVESTED AMOUNTS, ACCOUNT BALANCES, AND LOSSES ARE NOT FEES PAID TO THE COMPANY.
These limits apply across legal theories, including contract, tort, ordinary negligence, statute, and warranty, to the extent lawful, and apply collectively rather than separately to each Company Party. They reflect the allocation of risk underlying provision of the Service. They apply even if a limited remedy fails of its essential purpose, to the extent permitted by law.
Nothing in this agreement excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence where the law prohibits limitation, or another liability or remedy that cannot lawfully be excluded, capped, or waived. Mandatory securities, consumer, privacy, and data-protection rights remain intact. If a limitation cannot apply to you, liability is limited only as far as applicable law permits.
23. Indemnification and defense of third-party claims
To the extent permitted by applicable law, you will defend, indemnify, and hold harmless the Company Parties from third-party claims, demands, proceedings, damages, liabilities, judgments, settlements, and reasonable legal fees and expenses arising from your unlawful use of the Service, material breach of these Terms, unauthorized account connection or instruction, infringement of another person’s rights, or content you submit or publish in violation of your obligations. This obligation includes claims by an account owner or institution resulting from your lack of authority, and claims concerning unlawful or infringing issuer submissions.
This obligation does not apply to the extent a claim results from a Company Party’s breach, negligence, fraud, intentional misconduct, or other fault for which applicable law makes that party responsible. Consumer obligations apply only to the extent permitted by mandatory law and do not require you to indemnify us for ordinary authorized use of the Service.
We will provide reasonably prompt notice of a covered claim, permit reasonable participation in its defense, and provide reasonable cooperation at your expense where lawful. Failure to give prompt notice reduces your obligation only to the extent it materially prejudices the defense. We may assume control of a defense when reasonably necessary to protect our interests. You may not settle a claim in a way that admits fault for, imposes nonmonetary obligations on, or fails to release a Company Party without its prior written consent.
24. Suspension, termination, and account closure
You may stop using the Service and request account closure by contacting us. Disconnect brokerages and disable share links before closure if you can. We may suspend or terminate access for breach, abuse, fraud, security risks, legal or provider requirements, prolonged inactivity, or discontinuation of a feature, subject to required notice and other mandatory rights. We may investigate suspected violations and cooperate with lawful requests.
After termination, your permission to access restricted features ends. We may retain or delete records according to the Privacy Policy, applicable law, and any preservation obligations. Termination does not reverse completed transactions, eliminate accrued obligations, or automatically erase third-party copies. Ownership, lawful data retention, licenses intended to survive, disclaimers, liability limits, indemnification, dispute terms, and provisions that by nature must survive remain effective to the extent lawful.
25. Governing law, disputes, and venue
These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable United States federal law, without applying conflict-of-law rules that would displace those laws, except where mandatory protections of your place of residence require otherwise. Before filing a claim, you and the Company agree to try in good faith to resolve a dispute by written notice to charles@wolf.financial, describing the issue, relevant facts, and requested resolution. Either side may proceed after 30 days if unresolved. This informal process does not prevent urgent relief, a complaint to a regulator, use of small-claims procedures, or action needed to preserve a deadline.
Subject to mandatory consumer venue rights and any available small-claims process, courts of the Commonwealth of Puerto Rico located in San Juan, or the United States District Court for the District of Puerto Rico when federal jurisdiction exists, have exclusive jurisdiction over disputes arising from these Terms or the Service. You and the Company consent to those courts where this agreement may lawfully establish jurisdiction and venue.
TO THE EXTENT PERMITTED BY LAW, YOU AND THE COMPANY KNOWINGLY WAIVE A JURY TRIAL AND AGREE TO BRING CLAIMS INDIVIDUALLY, RATHER THAN AS A PLAINTIFF OR CLASS MEMBER IN A CLASS OR REPRESENTATIVE ACTION. THESE WAIVERS DO NOT APPLY WHERE PROHIBITED AND DO NOT RESTRICT NONWAIVABLE COLLECTIVE REMEDIES, PUBLIC INJUNCTIVE RELIEF, REGULATORY COMPLAINTS, OR OTHER PROTECTED RIGHTS. IF A WAIVER IS UNENFORCEABLE, THE AFFECTED CLAIM PROCEEDS AS REQUIRED BY LAW; NO ARBITRATION REQUIREMENT IS CREATED BY THESE TERMS.
For business users, a claim must be brought within one year after it accrues unless applicable law requires a different period or prohibits shortening it. This contractual deadline does not shorten a consumer’s mandatory limitation period or a nonwaivable statutory remedy. Neither informal discussions nor an attempted resolution waive any legal deadline unless the parties agree in writing or law provides otherwise.
26. Changes to these Terms and consent records
We may update these Terms prospectively. The page identifies its version and effective date. We will give notice of material changes through the Service or an appropriate account communication, and request renewed affirmative acceptance before access to account features when the legal version changes. Changes do not retroactively eliminate accrued rights or authorize a materially different use of previously collected personal information without any notice or consent the law requires.
We keep a record of the account, policy versions, acceptance time, entry point, and limited technical evidence associated with affirmative acceptance. A separate connection receipt covers portfolio-data authorization and acknowledgement of provider documents. These records support contract administration, compliance, and dispute resolution. You can request information about your receipts using the contact below.
27. General contract provisions
These Terms, applicable feature agreements, and expressly incorporated policies constitute the entire agreement about the Service and supersede prior general discussions on the same subject. A failure or delay in exercising a right is not a waiver. A waiver must be in writing and applies only to the specified matter. If a provision is invalid or unenforceable, it is limited or severed to the extent necessary, and the rest remains effective unless applicable law requires otherwise.
You may not assign this agreement without our written consent. We may assign it in connection with a reorganization, merger, acquisition, financing, or transfer of the Service, subject to applicable law, any required notice, and continuing privacy obligations. No assignment expands permitted uses of personal information. The parties are independent; these Terms do not create a partnership, employment relationship, joint venture, or fiduciary relationship.
The Company Parties are intended beneficiaries of provisions expressly protecting them, to the extent lawful; otherwise there are no third-party beneficiaries. Headings aid navigation and do not narrow the text. “Including” means including without limitation. Events outside a party’s reasonable control excuse performance only to the extent allowed by law and do not excuse payment already due or nonwaivable privacy, security, or consumer obligations.
Nothing here limits rights that cannot be waived, prevents communication with a regulator or law-enforcement body, restricts truthful lawful reporting, or requires secrecy about unlawful conduct. If mandatory local rights conflict with a clause, those rights prevail for the affected user and issue.
28. Contact and legal notices
The contracting operator is WOLF Financial Puerto Rico, LLC, Puerto Rico, United States. Direct questions about these Terms, contract notices, rights requests, accessibility, account closure, and complaints to charles@wolf.financial. Include enough detail to identify the relevant account or issue, but do not email passwords, authentication codes, full financial account numbers, or other unnecessary sensitive information. We may request proportionate verification before taking action on an account.
